1. Agreement to Terms
By downloading, installing, accessing, or using the FinArt iOS mobile application (the "App") provided by Frienteer Software Private Limited ("FinArt", "we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
Your license to use the App is also subject to Apple's Standard End User License Agreement (EULA) and the Apple Media Services Terms and Conditions.
2. Description of Service
- Track expenses, income, and transfers manually or via file import.
- Sync data across multiple devices.
- Optionally automate expense tracking via SMS processing using Apple Shortcuts (user-initiated).
- View financial insights and reports.
3. User Accounts
3.1 Registration
To use certain features (like cloud sync), you must sign in using your Apple ID or Google Account. You agree to provide accurate and complete information.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Privacy Policy
Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.
5. Subscriptions and Payments
5.1 Premium Features
Some features of the App may require a paid subscription ("Premium").
5.2 Billing
Subscriptions are managed and billed by Apple (App Store). Payment is charged to your Apple ID at confirmation of purchase. All payments, taxes, and currency conversions are handled by Apple.
5.3 Renewals and Cancellations
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscription in Settings > [your name] > Subscriptions on your device. We do not handle cancellations or refunds directly; these are subject to Apple's refund policies.
5.4 Price Changes
We reserve the right to change subscription prices at any time. Prices are set in the App Store and may vary by region and applicable taxes. Any price changes will take effect following notice to you through Apple's notification systems and, where required, will only apply after your consent or after your current period ends.
5.5 Free Trials (if offered)
If a free trial is offered, any unused portion is forfeited when you purchase a subscription. Unless canceled at least 24 hours before the trial ends, the subscription renews automatically at the listed price for the selected plan.
6. SMS Automation Feature
6.1 User Initiation
The SMS automation feature relies on an Apple Shortcut that you must explicitly set up. The App does not and cannot automatically access your SMS messages without this user-initiated setup.
6.2 Data Usage
By enabling this feature, you authorize the App to process the text of forwarded messages solely for the purpose of creating financial transaction records. As stated in our Privacy Policy, we minimize data collection to only what is necessary.
7. User Conduct
You agree not to:
- Use the App for any illegal purpose or in violation of any local, state, national, or international law.
- Reverse engineer, decompile, disassemble, or attempt to discover the source code of the App.
- Harass, abuse, or harm another person via the App's sharing features.
- Interfere with the security or proper operation of the App.
8. Intellectual Property
The App, including its code, design, graphics, and content (excluding your user data), is the property of Frienteer Software Private Limited and is protected by copyright and other intellectual property laws.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
NO FINANCIAL ADVICE: The App is a tracking and reporting tool. It does not provide financial, tax, or legal advice. You should consult a qualified professional for such advice. We are not responsible for any financial decisions you make based on data from the App.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FRIENTEER SOFTWARE PRIVATE LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.
11. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or updating the "Last Updated" date. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Chandigarh, India.
13. International Use
You may access and use the App from locations outside India. You are responsible for ensuring that your use of the App complies with all applicable local laws and regulations in your country of residence. We do not represent that the App or its content is appropriate or available for use in all locations.
